LAST WILL AND TESTAMENT OF CHEANG SAM TEO

Probate No. 10 of 1862

This is the last Will and Testament of me Cheang Sam Teo, of Singapore, Merchant, and I do hereby annul and revoke any and every other will or Testament by me at any time heretofore made, declaring this only to be my last Will and Testament.

EXECUTORS

I nominate and appoint my sons Cheang Hong Lim and Cheang Hong Guan, both of Singapore, Executors of this my last Will.

DEBTS AND EXPENSES

I direct that all my just debts and funeral and testamentary expenses be fully paid and satisfied by my said Executors as soon as conveniently may be after my decease.

BEQUESTS

To My Wife Gan E Neo

And I give and bequeath unto my wife Gan Neo, of Singapore:

  • The sum of Five thousand Dollars
  • Two Houses, viz: No. 63 China Street and No. 35 Nam Kim Street
  • All her Jewels and gold and silver articles
  • Besides the sum of One thousand Dollars for her funeral expenses

To My Sons

And I give and bequeath:

  • Unto my sons Cheang Hong Lim and Cheang Hong Guan, each the sum of Fifteen thousand Dollars
  • Unto my sons Cheang Hong Choon and Cheang Hong Leap, both of Singapore, each the sum of Ten thousand Dollars

To My Daughters

  • Unto my daughter Cheang Goe Neo, of Singapore, the sum of Three thousand Dollars, besides the sum of Five hundred Dollars for her marriage expenses, payable when she is to be married
  • Unto my daughter Hong Keao Neo, of China, the sum of One thousand Dollars, payable to her on her attaining the age of twenty-one years

To My Adopted Sons

Unto my adopted sons Hong Ong, Hong Kok, Hong Leong, Hong Keat, Hong Gwat, Hong Chee, and Hong Heong, all of China, each the sum of One thousand Dollars

To My Grandsons

Unto my grandsons Chean Teng, Chean Peng, and Chean Cheong, all of China, each the sum of One thousand Dollars

To My Wife in China

Unto my wife Kwae Neo, of China, the sum of One thousand Dollars

To Teo Yean Lean

And unto Teo Yean Lean, formerly of China, but at present of Singapore, the sum of Five hundred Dollars

ANCESTRAL HERITAGE - NON-ALIENABLE PROPERTIES

I do direct and my will is that my house situated in Teluk Ayer Street, now in the occupation of my family, and my Plantation situated in Tangling district, shall not be sold, mortgaged, alienated, or exchanged by either my sons, grandsons, great-grandsons, or other children, but be reserved forever as Ancestral Heritage for the free occupation of my Children who were born in this Settlement.

PROPERTIES FOR ANCESTRAL WORSHIP

I also desire that my Houses, viz:

  • Eighteen (18) Houses situated in Upper Hokkien Street
  • Nine Houses in Upper Nam Kin Street
  • Six Houses in New Bridge Road

shall not be sold, and that the Rents or Profits arising therefrom shall be appropriated towards the payment of the expenses of Sacrificing to my and my wife's "Sinchees" or Tablets, from time to time, in consistence with the Custom of the Chinese on such occasions.

REMITTANCE TO CHINA

I do direct and my further will is that my said Executors shall remit to China, after my decease, the sum of Four thousand Dollars to the care of my grandson Chean Teng as aforesaid, for the purpose of purchasing a House there as Ancestral Heritage, and of paying the expenses of Sacrificing to the "Sinchees" or Tablets of my deceased parents and ancestors from time to time.

SPIRIT AND OPIUM FARMS

With regard to the Spirit Farm in Singapore, and the Spirit and Opium Farm in Johore, that I have rented, I desire my said Executors to carry out the terms of the Agreements relating thereto respectively.

RESIDUARY ESTATE

And as to any surplus which shall remain after payment of my debts, funeral and testamentary expenses, and all the aforesaid legacies, I give the same to all my children and grandsons aforesaid, the said legacies to be divided amongst them in proportion to their respective quantums or amounts of their respective legacies.

ABATEMENT CLAUSE

Provided always that should there not be sufficient assets of my said Estate remaining, after payment thereout of my debts and funeral and testamentary expenses to pay and allow the whole of the several legacies herein before bequeathed, then I declare that the said legacies shall be reduced or abated in proportion to the respective quantums or amounts thereof.


IN WITNESS WHEREOF I have hereunto set my hand and seal this Sixth day of March A.D. 1862.


SIGNED, SEALED, PUBLISHED, AND DECLARED by the above named Cheang Sam Teo, the Testator, as and for his last Will and Testament, in the presence of us, who, at his request, in his presence, and in the presence of each other, have hereunto subscribed our names as witnesses thereto.
